In trust for better or worse

Divorce law for high net worth English residents has been in the spotlight in recent years. Last year it was the huge payouts for wives in the House of Lords case of Miller v Miller and MacFarlane v Macfarlane, which our firm covered with an exclusive lecture from Melissa Miller's winning team. This year we are continuing the tradition of providing some of our contact organisations and selected clients with authoritative insight from the leading practitioners at the Bar by focusing on trusts.

Trust law has become an especially hot topic in recent times with cases like Charalambous and Charman redefining the law with some rather shocking results. Clients who have thought their assets were protected and not available in their divorces have been forced to re-evaluate, and, correspondingly, their advisors have had to manage and adjust client expectations. The treatment of trust assets on divorce can also have implications for the choice of investment vehicle and all those managing funds should be aware of the current developments.
